NOTICE OF PUBLIC COMMENT – PERMIT RENEWAL – NIELSON CONSTRUCTION CLASS V LANDFILL

Nielson Construction has submitted an application for a permit renewal for the Nielson Construction Class V landfill located north of Castle Dale, Utah.  The proposed permit application for renewal of the Class V landfill has been reviewed and determined to be complete and in compliance with the Utah Solid Waste Permitting and Management Rules.  This permit renewal allows the facility to continue to operate the Class V landfill for ten years after the permit renewal has been approved.  The required public comment period for the draft permit begins on November 7, 2019 and ends on December 9, 2019.

Written comments will be accepted if received by 5:00 p.m. on December 9, 2019 and should be submitted to the address below. Comments can also be hand delivered to the Division address above and must be received by 5:00 p.m. on December 9, 2019.

Under Utah Code Section 19-1-301.5, a person who wishes to challenge a Permit Order may only raise an issue or argument during an adjudicatory proceeding that was raised during the public comment period and was supported with sufficient information or documentation to enable the Director to fully consider the substance and significance of the issue.
