RESOLUTION 2019-01

A RESOLUTION AMENDING THE WELLINGTON CITY GENERAL PLAN, BY ADOPTING MODERATE INCOME HOUSING ELEMENT, AS PART OF THE WELLINGTON CITY GENERAL PLAN.

WHEREAS, Utah Code 10-9a-103(41) and Utah Code 10-9a-408 require each city in the State of Utah, with a population of one thousand or more residents, to conduct a review of and revise the Moderate Income Housing Element of its General Plan every five years; and

WHEREAS, the Wellington City Council, initiated a review of the Moderate Income Housing Element of the Wellington City General Plan, as part of a comprehensive amendment; and

WHEREAS, the Wellington City Council did hold a public hearing regarding the proposed amendment during the first regularly scheduled public meeting of the Wellington City Council immediately following the said period of public notice on the 9th day of January, 2019;

WHEREAS, the Wellington City Planning Commission upon receiving and carefully reviewing the input, documents, and testimony from the public did prepare its final recommendation regarding the proposed comprehensive amendment to the Wellington City General Plan; and

WHEREAS, the Wellington City Council has received and carefully reviewed the final recommendation from the Planning Commission regarding the proposed amendment, and the minutes from the Wellington City Planning Commission meetings and public hearing regarding the proposed comprehensive amendment to the Wellington City General Plan; and

WHEREAS, the Wellington City Council finds the proposed comprehensive amendment to the Wellington City General Plan, contains all mandated elements of the Utah State Code and has been updated to meet current and future moderate income housing needs of Wellington City; and

WHEREAS, the Wellington City Council finds the proposed comprehensive amendment to the Wellington City General plan, is in the best interest of the health, safety, and welfare of the residents of Wellington City, considering all factors.

NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE BODY OF WELLINGTON AS FOLLOWS:

PART I:

The City Council of Wellington, Carbon County, State of Utah, that Wellington City hereby adopts Resolution 2019-01, approving Amendment “Moderate Income Housing Element, 2018” as part of the city’s General Plan in compliance with state statues (Utah Code 10-9a-103(41), Utah Code 10-9a-403(2), Utah Code 10-9a-404, and Utah Code 10-9a-408).

PART II:

The Wellington City General Plan is hereby amended to read as follows:

See attached Amendment “Moderate Income Housing Element, 2019”

PART III:

A copy of the Wellington City General Plan, as amended herein, is hereby ordered to be filed and retained by the Wellington City Recorder.

PART IV:

An electronic copy of the Amendment “Moderate Income Housing Element, 2019” is hereby order to be filed with the both Southeastern Utah Association of Local Governments and the Housing and Community Development Division of the Utah Department of Workforce services.

PARTY:

If any of the sections, sentences, clauses, or provisions of this general plan shall for any reason be adjudged inapplicable or invalid by a court of competent jurisdiction, such shall not affect or invalidate the remaining portion contained herein.

PART VI:

This resolution shall become effective fifteen (15) days after it is passed and upon promulgation through the website of Wellington City and in the ETV Newsweekly newspaper, a newspaper having general circulation in Wellington City.

Motion for the adoption of this resolution was made by Council member Willson and seconded by Council member

Nayes and motion carried by a vote as follows: Paula Noyes, Glen Wells, Marvon Willson and Gary Rich.

PASSED AND ADOPTED BY THE WELLINGTON CITY COUNCIL THIS 9TH DAY OF JANUARY, 2019.
