4 Arrested in Emery County Drug Bust Appear at First Court Hearing

UPDATE: JUNE 24, 2019 – Four suspects that were arrested in Elmo on June 18 had their initial appearance in the Seventh District Court on Monday. Judge George M. Harmond read formal charges against each defendant.

Charges are as follows: BRANDY BURGESS, four (4) counts of Distribute/Offer/Arrange Distribution of Controlled Substance – all Second Degree Felonies; and one (1) count of Use or Possession of Drug Paraphernalia, a Class A Misdemeanor. AMBER HUFFMAN, one (1) count of Use or Possession of Drug Paraphernalia, a Class B Misdemeanor; three (3) counts of Distribute/Offer/Arrange Distribution of a Controlled Substance – all Second Degree Felonies; and one (1) count of Possession or Use of a Controlled Substance, a Class B Misdemeanor.

FRANK BURGESS, three (3) counts of Distribute/Offer/Arrange Distribution of Controlled Substance, all Second Degree Felonies; one (1) count of Possession of Controlled Substance Marijuana/Spice, a Class A Misdemeanor, and one (1) count of Manufacture/Deliver Drug Paraphernalia, a Class A Misdemeanor. TRAVIS HEATON, three (3) counts of Distribute/Offer/Arrange Distribution of a Controlled Substance, all Second Degree Felonies; one (1) count of Use or Possession of Drug Paraphernalia, a Class B Misdemeanor; and one (1) count of Possession of Controlled Substance Marijuana/Spice, a Class A Misdemeanor. Additionally, each was charged with three (3) counts of Possession of a Dangerous Weapon by a Restricted Person, all Third Degree Felonies.

Bail remains the same (Brandy Burgess, $81,000; Frank Burgess, $82,950; Travis Heaton, $91,680; and Amber Huffman, $90,360) and reflects the standard bail schedule for the number and seriousness of charges against the individuals. All four remain incarcerated.
