AN ORDINANCE AMENDING THE PROVISIONS OF THE LAND USE CODE, TITLE 12, OF THE WELLINGTON CITY CODE PERTAINING TO THE TEMPORARY USE OF RECREATIONAL VEHICLES AND MOBILE HOMES
WHEREAS, Wellington City has determined a need to address an the of unauthorized use of recreational vehicles and mobile homes being used for living outside of permitted Mobile Home Parks; and
WHEREAS, the Wellington City staff, and city attorney have reviewed the provisions of the Land Use Code, Title 12
Chapter 13 Mobile to determine the need to provide specific language to address the issue; and
WHEREAS, the Wellington City Planning and Zoning Commission, in accordance with Title 12, held a public hearing on July 1, 2020 to review the proposed additions.
NOW THEREFORE, BE IT ORDAINED, by the City Council of Wellington City, Utah as follows:
SECTION I – ORDINANCE
1. Section 12-13-9 is created to read as follows:
TEMPORARY USE OF RECREATIONAL VEHICLES OR MOBILE HOMES. It shall be unlawful to place a recreational vehicle or mobile home on any lot not subject to a permitted recreational vehicle court for the purpose of using the same for human habitation, except when such use is of a temporary nature not to exceed fourteen (14) days within a six (6) month period.
A violation of the provision shall be a Class B Misdemeanor, and each additional day of non-compliance shall constitute a separate offense.
SECTION 2 – EFFECTIVE DATE. This Ordinance shall take effect on July 16, 2020 on day after Legal Notice has been published in a matter that complies with Utah State Code.
PASSED AND ADOPTED by the Wellington City Council at a regularly scheduled City Council meeting held on the 8th day of July 2020.
