The purpose of this public notice is to declare the state of Utah’s intention to renew a Utah Pollutant Discharge Elimination System (UDPES) General Permit under authority of the Utah Water Quality Act, Section 19-5-104 and 107, Utah Code Annotated 1953, as amended. Said “permit” refers to UPDES Permit and the Fact Sheet and Statement of Basis (including the total maximum daily loads (TMDL’s)) if applicable, as per Section 303 (d) of the Federal Clean Water Act (CWA).

BACKGROUND
Utah Administrative Code (UAC) Section R317-8-2.5 authorizes the issuance of general permits to categories of point sources within the same geographical area, which involve similar types of operations, discharge the same types of wastes, and require similar effluent limitations and pollution control measures. This general permit will cover discharges of wastewater and storm water from coal mining operations in Utah. The following facilities (with permit numbers) have submitted Notice of Intent applications for coverage under the General Permit for Coal Mining Operations: Savage Coal Terminal (UTG040005), Castle Valley Mining (UTG040006), Wildcat Loadout (UTG040007), Hunter Prep Plant (UTG040009), Wellington Prep Plant (UTG040010), Banning Loadout Facility (UTG040011), Utah American Energy, Inc. – Lila Canyon Mine Facility (UTG040024), Star Point Refuse Pile (UTG040025), Bronco Utah Operations – Hidden Valley Mine (UTG040026), Utah American Energy, Inc. – Tower Mine Facility (UTG040029), and Kinney No. 2 Mine (UTG040030). This renewal permit will once again authorize any future discharges from successful permit applicants during the next five years.

Public comments are invited any time prior to the deadline of the close of business on March 28, 2019.
