These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Southeastern Utah Association of Local Governments.
REQUEST FOR THE RELEASE OF FUNDS
On or about May 14, 2021, Carbon County will authorize the Southeastern Utah Association of Local Governments (SEUALG) to submit a request to the State of Utah, Department of Workforce Services, Housing and Community Development Division (HCD) for the release of Community Development Block Grants Funds (CDBG) under Title I of the Housing and Community Development Act of 1974 (PL93-383) to undertake the project known as Engineering for New AOG Building for the purpose of constructing a new association of governments building located at approximately 400 South Fairgrounds Road, Price, UT. The project will include the following: design and engineering for the construction of a new administration building, food bank warehouse, weatherization warehouse, parking lots and transit hub for the SEUALG. SEUALG has received $300,260 as a grant from CDBG to cover the costs of design and engineering. SEUALG has received $6,936,000 as a grant from the Permanent Community Impact Board (CIB) to complete the construction of the project. SEUALG also received a donated parcel of land from Carbon County with a value of $189,000 upon which to build. The total estimated cost of the project is $7,425,260.
FINDING OF NO SIGNIFICANT IMPACT
Carbon County has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the SEUALG office and is available for public examination and copying at 375 South Carbon Ave, Price, UT 84501, weekdays between the hours of 10:00 am to 3:00 pm. PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to Jade Powell, Deputy Director at SEUALG at PO Box 1106, Price, UT 84501. All comments received by May 13, 2021 will be considered by Carbon County prior to authorizing submission of a Request for Release of Funds. Comments should specify which notice they are addressing.
ENVIRONMENTAL CERTIFICATION
Carbon County certifies to HCD that Tony Martines in his capacity as County Commissioner and also Treasurer of the SEUALG Executive Board consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HCD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows SEUALG to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HCD will accept objections to its release of funds and Carbon County’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if objections are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Carbon County; (b) Carbon County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) SEUALG or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before the approval of a release of funds by HCD; or (d) another Federal agency, acting pursuant to 40 CFR part 1504, has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures of 24 CFR Part 58, Sec. 58.76 and shall be addressed to Sarah Moore, Utah Department of Workforce Services, Housing & Community Development Division (HCD), 1385 South State, Suite 400, Salt Lake City, Utah 84115. Potential objectors should contact Sarah Moore at HCD (801) 834-4609 to verify the actual last day of the objection period.
