NOTICE OF TRUSTEE’S SALE

The following described real property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the time of sale, at the main entrance of the Carbon County Seventh District Courthouse, 120 East Main Street, Price, Utah 84501, on May 26, 2023 at 11 :00 a.m. of said day for the purpose of foreclosing a Trust Deed dated September 22, 2017, executed by WILLIAM L. WILLIAMS, as Trustor, wherein Pettey & Associates Law Office, LC, is the Trustee, and DAVID B KENNEY, a married man, is the Beneficiary, and which covers the following described real property located in Carbon County, State of Utah, more particularly described as:

All of Lots 14A and 14B, GOLDING ESTATES, AMENDMENT #3, according to the official plat thereof, recorded in Book 5 of Plats, at Page 5, in the records of the County Recorder of Carbon County, Utah. EXCEPTING therefrom all oil, gas and mineral rights previously reserved, conveyed or otherwise severed from the surface estate.

Tax ID#: 02-2308-014A and 02-2308-14B.

The property address is purported to be 3896 East 6875 South, Price, Utah 84501. The undersigned disclaims any liability for errors in the street address.

Said Trust Deed was recorded October 3, 2017, as Entry No. 838081, in Book 895, at Page 216 of Official Records. Notice of Default was recorded January 17, 2023, as Entry No. 863652, in Book 1042, at Page 116 of Official Records.

The current beneficiary of the Trust Deed is David B Kenney, and the record owner of the property as of the recording of the Notice of Default is reported to be David B Kenney.

The Sale will be made without covenant or warranty, express or implied, regarding title, possession or encumbrances.

The successful bidder must tender a bank or credit union cashier’s check or bank official check for $20,000.00 to the trustee at the sale and a bank or credit union cashier’s check, bank official check or wire transfer for the balance of the purchase price within 24 hours after the sale. Checks should be made payable to Pettey & Associates Law Office, LC. Cash will not be accepted. A successful bidder who fails to tender the full purchase price will forfeit the entire deposit.

This Trustee’s Sale is subject to payoff, reinstatement, bankruptcy filing, incorrect bidding instructions, or any other condition that would affect the validity of the sale. Should any of these conditions exist, this sale shall be set aside, the successful bidder’s funds shall be returned, and the trustee, successor trustee and the beneficiary shall not be liable to the

successful bidder for interest or any other damages.

A trustee’s deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
