Canyon Fuel Company, LLC (“CFC”) has filed with the Division of Oil, Gas and Mining an application for Phase I & II Bond Release for 21.6 acres of the Banning Loadout Site. The permit for operations pertaining to surface mining activities was approved on October 24, 1988 and has been approved every five years since.
Description of Areas Meeting the Requirements for Phase I & II Bond Release:

Sec 16: Portions of E1/2SE1/4
Sec 22: Portions of W1/2NW1/4NW1/4
Operations at the Banning Loadout Site were terminated in 2000. The site remained in a state of temporary cessation from 2000 to 2021. Final site reclamation began in September 2021 and was completed in April of 2022.
Phase I & II Bond Release can be considered after the applicant has demonstrated to the Division that all reclamation requirements have been satisfied for backfilling, regrading, drainage control and demonstration that the site is not contributing excess suspended solids to surface water flow outside of the permitted area. Topsoil has also been replaced, drainage channels have been constructed, and sediment control measures (including revegetation and permanent retention devices) have been provided at the reclaimed site. CFC asserts that it has satisfied the Phase I & II Bond Release requirements. A surety bond is filed with the Division for $350,000.00. The total required bond liability for the site is currently $295,000. For the Phase I & II Bond Release application, CFC is requesting an 80% release ($236,000) on its reclamation liability.
A copy of the Phase I & II Bond Release application may be examined at the office of the Division of Oil, Gas and Mining, 1594 West North Temple, Suite 1210, Salt Lake City, Utah 84114-5801 and also at the Recorders Office located in the Carbon County Courthouse in Price, Utah. Written comments, objections, or requests for an informal conference may be submitted to the Division of Oil, Gas, and Mining address above. Said comments must be submitted thirty (30) days from the date of the last publication of this notice.
